The European Union Intellectual Property Office (EUIPO) in collaboration with the European Commission has launched a fund for financial support of SMEs through which Estonian companies can apply for reimbursement of basic fees for their trademark and design applications.

The Ideas Powered for Business SME Fund is a support system designed to help small and medium-sized enterprises (SMEs) in the EU to use their intellectual property rights. The resources are limited and will be allocated on a first-come, first-served basis.


What is reimbursed?

The SME Fund is a reimbursement scheme that provides grants to cover part of the fees paid for certain activities. Two types of payments are available depending on the activity:

GRANT 1: €1,500 to be used for trademark and design fees

GRANT 2: 750 euros for payment of patent fees.


Who can claim compensation?

The SME Fund offers financial support to SMEs established in the European Union that act as EU companies, have less than 250 employees and an annual turnover less than €50 million and/or an annual balance sheet not exceeding €43 million.

The application in the name of an SME in the EU may be filed by its owner, employee or authorized representative (including a patent attorney). Grants are always paid directly to the SME.

What steps have to be taken to receive compensation?

The first step is to complete a claim form on the basis of which EUIPO verifies whether the company meets the SME condition. If necessary, EUIPO forwards the decision on grant. In case of rejection the reasons shall be given. After a positive decision, the application for a trademark and/or design has to be filed within 30 days with an office in a Member State of the European Union, with the Benelux Office or the EUIPO, and the official fee has to be paid. After the payment of the fee(s), the request for reimbursement must be submitted to the EUIPO, the link to which can be found in the decision on the award of the grant. The payment must be made within one month and the beneficiary will be notified.
